Olivia Bennette is operated by a Dutch registered general partnership (VOF), conducting international e-commerce activities.

2. Eligibility

3. Product Information & Availability

We make every reasonable effort to ensure that product descriptions, images, and pricing are accurate.

However:

  • Minor variations in materials or stitching may occur
  • Inventory availability is not guaranteed

All offers are subject to availability and may be withdrawn at any time.

4. Pricing & Currency

All prices are listed in CAD (Canadian Dollars), unless otherwise indicated.

Prices may change without notice.

Customs duties, import taxes, clearance fees, and other charges imposed by Canadian authorities are not included in product prices.

5. Order Formation & Acceptance

The display of products on this website constitutes an invitation to purchase, not a legally binding offer.

A contract is formed only once:

  2. You receive an order confirmation email.

We reserve the right to refuse, cancel, or limit orders in cases of:

  • Fraud suspicion
  • Pricing errors
  • Availability issues
  • Abuse of policies

6. Shipping & Delivery (DDU – Delivered Duty Unpaid)

All international shipments are dispatched under the delivery principle of Delivered Duty Unpaid (DDU).

This means:

  • The customer acts as the importer of record
  • The customer is solely responsible for:

Import duties

Customs taxes (including GST/HST where applicable)

Brokerage or clearance fees

Compliance with Canadian import regulations

Olivia Bennette:

  • Does not collect customs duties in advance
  • Is not responsible for customs delays
  • Is not liable for confiscation or refusal due to local import regulations

Risk of loss transfers to the customer upon confirmed delivery by the carrier.

Failure to pay customs fees does not create a right to refund.

7. Returns & Refunds

All returns and refunds are governed exclusively by our Return & Refund Policy.

Returns must comply with:

  • 30-day return window
  • Eligibility conditions
  • Hygiene exclusions
  • Authorization requirement prior to shipment

Returns without approval may be refused.

8. Lost, Refused, or Unclaimed Shipments

If a package is:

  • Refused
  • Unclaimed
  • Returned due to incorrect address
  • Not cleared through customs

Shipping, administrative, and related handling costs may be deducted from any eligible refund.

Once tracking indicates “Delivered,” we are not responsible for loss or theft.

9. Intellectual Property

All content on this website — including logos, product images, text, branding, and design — is the exclusive property of Olivia Bennette.

10. Limitation of Liability

Our total liability shall not exceed the purchase price of the product in question.

  • Government restrictions
  • Customs inspections
  • Transport disruptions
  • Global supply chain interruptions

14. Entire Agreement

These Terms & Conditions, together with our Shipping Policy, Return & Refund Policy, and Privacy Policy, constitute the entire agreement between you and Olivia Bennette.

They supersede any prior communications, agreements, or understandings.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of the Netherlands.

However, mandatory consumer protection provisions applicable in the customer’s jurisdiction (including Canada) shall apply where legally required.

Any disputes shall be submitted to the competent courts of the Netherlands, unless mandatory consumer law requires otherwise.

16. Amendments

We reserve the right to update these Terms at any time.

Continued use of the website after changes constitutes acceptance of the revised Terms.
